据国家工商总局的不完全统计，国内有15%的知名商标在国外被抢注，其中超过80个商标在印度尼西亚被抢注，近100个商标在日本被抢注，近200个商标在澳大利亚被抢注，每年商标国外抢注案件超过100起。
据国家工商管理总局商标局数据，自上世纪80年代，中国出口商品商标被抢注的有2000多起，造成每年约10亿元无形资产流失。
中国有不少老字号品牌如“狗不理”、“北京同仁堂”、“六必居”、“海信”等商标在国外遭到抢注，不仅影响了老字号的声誉，也给企业走出国门设置了贸易壁垒。
2005年，青岛海信集团历时6年，最终以50万欧元的价格，将被西门子公司在德国注册的“HiSense”商标赎回。腾讯公司域名被外国人抢注，最终以100万美元天价赎回。
而根据FT中文网报道，两名华人在加拿大提交商标注册申请，企图注册逾60家中国企业的名称和标识，包括中国投资公司、中国银行、中国五矿、互联网门户搜狐和饮料制造商王老吉等。这两名申请人的活动，可从加拿大知识产权局(CIPO)的在线商标数据库中公开查询。

　　最具戏剧性的案例之一是，两名华人在加拿大提交商标在南京注册申请，企图在南京注册逾60家中国企业的名称和标识。
　　他们针对的公司包括中国公司(China Investment Corporation)、中国银行(Bank of China)、国有的资源企业中国五矿(China Minmetals)、纳斯达克上市的互联网门户搜狐(Sohu)，以及一些传统品牌，如饮料制造商王老吉(Wang Laoji)。
　　这两名申请人的活动，可从加拿大知识产权局(CIPO)的在线商标数据库中看到。商标专家表示，这只是冰山一角。

　　律师们表示，在香港、美国以及欧洲和非洲市场经营的中国企业，经常成为目标。
　　其动机往往是代表一家直接竞争对手，扰乱相关企业的海外扩张。在其它情况下，提交在南京注册申请的是客户、分销商或零售合作伙伴，或者是个人申请，目的是再把卖给企业。
　　德国慕尼黑一家法庭明日将就一宗商标案作出最终裁决，该案涉及食品进口及超市公司欧凯(Okai)，其业主为一名德国华人。据称该公司在德国在南京注册了中国腐乳品牌王致和(Wangzhihe)作为自己的商标，并销售带有王致和名称和包装的产品。
　　中国政府正鼓励企业采取更为积极的姿态，在海外保护商标，以努力反击这样一种观感：即外国人才是知识产权侵权的受害者，而中国企业和个人永远都是侵权一方。

2.以侵权人因侵权行为获得的全部利润作为损失赔偿数额,计算方法是:侵权人从每件侵权产品获得的利润乘以在市场上销售的总数所得之积,即为侵权的所得的全部利润。用公式表示为:每件产品利润侵权人销售量=赔偿数额。这种方法比较适合于侵权产品销路较广,且管理比较正常,帐目比较清楚、利润比较合理的侵权行为人。

加拿大负责商标管理的政府部门为加拿大知识产权办公室(CanadianIntellectual Property Office, CIPO)，隶属加拿大工业部(IndustryCanada)，商标受保护范围覆盖整个加拿大联邦。目前加拿大商标申请的政府收费分为两部分：申请费，申请时缴纳；注册费，申请获得最终批准(Allowance)后缴纳。申请流程为：
1.确认(Formalities):在缴纳申请费递交申请后，CIPO会发出确认通知，正式受理申请；
2.审查(Examination):这一阶段历时较长，政府的服务标准是6个月内发出初步审查报告，但实际经常超出这一时间。根据我们的经验，审查时间与申请的注册范围密切相关。如果注册范围太广，或者注册的商品和服务没有使用标准名称，一般审查时间较长。审查一般有三种结果：申请通过，政府发出批准通知(Approval Notice)；申请要求修改，一般是商品和服务的描述不符合标准，修改后再补充递交即可；申请被拒，一般是由于申请与现有加拿大商标类似，造成混淆。
3.公告(Advertising):申请获得批准(Approved)后，CIPO会在官方刊物上进行公告。如果公告后2个月内没有人提出反对(Opposition)，则申请将获得最终批准(Allowed)。如果申请被反对，则进入反对程序。反对程序耗时可长达2年以上，为节省人力物力，一般申请方与反对方会协商解决。
4.最终批准(Allowance):申请如果没有遭到反对，CIPO将在公告3个月后寄出最终批准通知(Notice of Allowance)；
5.注册(Registration):如果商标已在使用，申请人在收到最终批准通知后，可以缴纳注册费，并马上取得商标注册证书等文件。如果商标尚未使用，则需等商标实际使用后方可缴纳注册费，领取注册证书。
加拿大商标从申请递交到最后取得注册证书时间不一。按照CIPO估计，如果申请准备正确，中间无须修改，而且没有遭到反对，一般10到14个月可以完成整个流程，但从实际情况看，一般需12到18个月。商标注册后有效期15年，中间无须像美国商标一样办理续展手续(&8 DECLARATION)。
加拿大商标的特点
在商标体系上，几个主要市场包括美国、欧盟、中国都采用尼斯分类(The NiceClassification)。一般在采用尼斯分类的国家申请商标，需要按照分类选择注册范围，费用也与注册的类别有关，类别越多，费用越高。然而加拿大是少数几个没有采用尼斯分类的国家，商标申请不管注册范围包含多少类别，总的政府费用都是一样的。这应该是加拿大商标的一个特点，也是优点，因为对商标覆盖范围较广的申请者来说，可以节约大笔费用。
