　　新京报讯 （记者林野）儿子贷款买房后突发疾病去世。67岁的年迈父亲替子还贷五个月后无力继续，遂起诉某房地产公司，请求法院判其退还购房款，并收回房屋。昨天，顺义法院开庭审理此案，被告代理人表示愿意和房地产公司协商，帮老人将房子卖出。
　　无力为子还房贷 父请求解除购房合同
　　2013年，李远（化名）的儿子李征（化名）与某房地产公司签订协议，购买顺义一处房子，总价约102.5万，付款方式为商业贷款。
　　当年9月，双方正式签订商品房预售合同。10月，李征向该房地产公司支付首付款41万余元。
　　去年1月，李征向银行贷款61万元，于当日打入房地产公司的账户。去年2月起，李征开始偿还贷款。
　　今年4月，李征因病去世，并无子女，其父母成为第一继承人。
　　为不违约，李远每月向银行还房贷，一直到现在。由于李远夫妇除了每人每月400元左右的国家补助外再无生活来源，且李远每月要承担上千元的医疗费，二人已无法承担还贷压力。
　　基于此，李远向法院提起诉讼，请求解除其子与被告签订的购房合同，被告收回房屋，退还钱款。
　　庭审现场，原告代理人表示，本案被告虽然将房屋交付给李征，但根据法律规定，不动产所有权于登记之日才发生变更，现李征过世，已无法完成变更不动产，合同也无法履行。
　　“我们卖房只能以李征的名义卖，但是李征已经死亡，而且我方无力偿还房屋贷款，因此只能选择退房。”代理人说，合同第22条规定应该在2016年办理楼的权属，然后才能办理转移登记，现在房屋所有权还在被告名下。
